Stat. tit. 43A, § 43A-5-206","heading":"Definitions","body":"As used in Sections 5-206 through 5-209 of this title:\n\n1. \"Mental health evaluation\" means the examination of a\n\nperson, either in person or via telemedicine, who appears to have a\n\nmental illness or be alcohol- or drug-dependent by two licensed\n\nmental health professionals, at least one of whom is a psychiatrist\n\nwho is a diplomat of the American Board of Psychiatry and Neurology,\n\na licensed clinical psychologist, or a licensed Doctor of Medicine\n\nor Doctor of Osteopathy who has received specific training for and\n\nis experienced in performing mental health therapeutic, diagnostic,\n\nor counseling functions, for the purpose of:\n\na. determining if a petition requesting involuntary\n\ncommitment or treatment is warranted,\n\nb. completing a mental health evaluation pursuant to\n\nSection 5-414 of this title, or\n\nc. both subparagraphs a and b of this paragraph;\n\n2. \"Initial assessment (medical necessity review)\" means the\n\nexamination of a person, either in person or via telemedicine, who\n\nappears to be a mentally ill person, an alcohol-dependent person, or\n\na drug-dependent person and a person requiring treatment, whose\n\ncondition is such that it appears that emergency detention may be\n\nwarranted by a licensed mental health professional at a facility\n\napproved by the Commissioner of Mental Health and Substance Abuse\n\nServices, or a designee, as appropriate for such examination to\n\ndetermine if emergency detention of the person is warranted;\n\n3. \"Emergency detention\" means the detention of a person who\n\nappears to be a person requiring treatment in a facility approved by\n\nthe Commissioner of Mental Health and Substance Abuse Services as\n\nappropriate for such detention after the completion of an emergency\n\nexamination, either in person or via telemedicine, and a\n\ndetermination that emergency detention is warranted for a period not\n\nto exceed one hundred twenty (120) hours or five (5) days, excluding\n\nweekends and holidays, except upon a court order authorizing\n\ndetention beyond this period or pending the hearing on a petition\n\nrequesting involuntary commitment or treatment as provided by\n\nSection 5-206 et seq. of this title. If during the emergency\n\ndetention a person who appears to be a person requiring treatment\n\nbecomes medically unstable, the time limit on the emergency\n\ndetention period stipulated in this paragraph shall be tolled until\n\nthe person who appears to be a person requiring treatment is\n\nmedically stabilized;\n\n4. \"Protective custody\" means the taking into protective\n\ncustody and detention of a person pursuant to the provisions of\n\nSection 5-208 of this title until such time as an emergency\n\nexamination is completed and a determination is made as to whether\n\nor not emergency detention is warranted; and\n\n5. \"Prehearing detention\" means the court-ordered detention of\n\na person who is alleged to be mentally ill, alcohol-dependent, or\n\ndrug-dependent in a facility approved by the Commissioner as\n\nappropriate for such detention, pending a hearing on a petition\n\nrequesting involuntary commitment or treatment as provided by\n\nSection 5-415 of this title.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"45153fa85492798d9abd4b19f2ead2592bffa75406f54c8b19b76f7107e0d3a7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-5-204","next":"us-ok/okla.-stat.-tit.-43a-43a-5-207"},"notice":"GroundRules: Original legal text.
