Stat. tit. 43A, § 43A-5-209","heading":"Additional period of detention - Petition - Order -","body":"Notification of interested parties of detention.\n\nA. A person may be detained in emergency detention more than\n\none hundred twenty (120) hours or five (5) days, excluding weekends\n\nand holidays, only if the facility in which the person being\n\ndetained is presented with a copy of an order of the district court\n\nauthorizing further detention. Such order may be entered by the\n\ncourt only after a petition has been filed seeking involuntary\n\ncommitment or treatment pursuant to the provisions of Section 5-410\n\nof this title.\n\nB. If a copy of an order for further detention is not delivered\n\nto the facility by the end of the period of emergency detention, the\n\nperson alleged to be a mentally ill person, an alcohol-dependent\n\nperson, or a drug-dependent person and a person requiring treatment\n\nshall be discharged from the facility in which detained unless said\n\nperson has applied for voluntary treatment.\n\nC. The person being held in protective custody or emergency\n\ndetention shall be asked to designate any person whom such person\n\nwishes informed regarding the detention. If the person being held\n\nin protective custody is incapable of making such designation, the\n\npeace officer holding the person in protective custody shall notify\n\nwithin twenty-four (24) hours of taking the person into protective\n\ncustody, other than the person initiating the request for protective\n\ncustody, the attorney, parent, spouse, guardian, brother, sister, or\n\nchild who is at least eighteen (18) years of age of the person.\n\nFailure of the sheriff to find such person shall within a reasonable\n\ntime be reported to the administrator of the facility.
