Stat. tit. 43A, § 43A-5-309","heading":"Detention against will prohibited - Notice of desire to","body":"be discharged.\n\nNo consumer admitted to a state or private mental hospital under\n\nthe provisions of the Mental Hospital Voluntary Admission Procedures\n\nAct shall be detained in a mental hospital against the will of the\n\nperson more than one hundred twenty (120) hours or five (5) days,\n\nexcluding weekends and holidays, after the consumer gives notice in\n\nwriting to the executive director of the facility of the desire of\n\nthe consumer to be discharged from the facility. If during the\n\nemergency detention the consumer becomes medically unstable, the\n\ntime limit on the emergency detention period stipulated in this\n\nsection shall be tolled until the consumer is treated at a medical\n\nfacility and is medically stabilized.
