The following persons may file or request the district\n\nattorney to file a petition with the district court, upon which is\n\nhereby conferred jurisdiction, to determine whether an individual is\n\na person requiring treatment, and to order the least restrictive\n\nappropriate treatment for the person:\n\n1. A treatment advocate as defined in Section 1-109.1 of this\n\ntitle;\n\n2. The father, mother, husband, wife, grandparent, brother,\n\nsister, guardian or child, over the age of eighteen (18) years, of\n\nan individual alleged to be a person requiring treatment;\n\n3. A licensed mental health professional;\n\n4. A person in charge of any correctional institution;\n\n5. Any peace officer within the county in which the individual\n\nalleged to be a person requiring treatment resides or may be found;\n\nor\n\n6. The district attorney in whose district the person resides\n\nor may be found.\n\nB. The petition shall contain a statement of the facts upon\n\nwhich the allegation is based and, if known, the names and addresses\n\nof any witnesses to the alleged facts.\n\n1. The petition shall be verified and made under penalty of\n\nperjury.\n\n2. A request for the prehearing detention of the individual\n\nalleged to be a person requiring treatment may be attached to the\n\npetition.\n\n3. If the individual alleged to be a person requiring treatment\n\nis being held in emergency detention, a copy of the mental health\n\nevaluation shall be attached to the petition.\n\nC. Petitions filed to determine if an individual should be\n\nordered to assisted outpatient treatment as defined by Section 1-103\n\nof this title shall only be filed by a licensed mental health\n\nprofessional employed by the Department of Mental Health and\n\nSubstance Abuse Services or employed by a community mental health\n\ncenter certified by the Department pursuant to Section 3-306.1 of\n\nthis title.\n\nD.
