If a mental health evaluation is not attached to a petition\n\nalleging a person to be a person requiring treatment at the time the\n\npetition is filed, the court shall order the person who is the\n\nsubject of the petition to undergo a mental health evaluation by two\n\nlicensed mental health professionals, and a mental health evaluation\n\nto be completed and filed with the court prior to the hearing.\n\n1. The mental health evaluation shall be conducted on an\n\noutpatient basis unless the court has issued an order for prehearing\n\ndetention.\n\n2. A copy of all petitions, orders, affidavits, powers of\n\nattorney, advance health care directives, treatment advocate\n\ndesignations, mental health advance directives, guardianships,\n\npolice reports and other relevant documents shall accompany the\n\nperson to the place where the mental health evaluation is to be\n\nconducted.\n\n3. Upon completion of the mental health evaluation, the\n\nfacility shall transmit a copy of the evaluation prepared by the\n\nlicensed mental health professionals to the court and to the\n\nattorney of record for the person evaluated.\n\nB. The report of the licensed mental health professionals\n\nconducting the mental health evaluation pursuant to this section\n\nshall include written findings as to whether:\n\n1. The person being evaluated appears to be a person requiring\n\ntreatment as defined in this title, and is reasonably likely to\n\nbenefit from mental health or substance abuse treatment; and\n\n2. Based on the following, inpatient treatment is the least\n\nrestrictive alternative that meets the needs of the person:\n\na. reasonable efforts have been made to provide for the\n\nmental health or substance abuse treatment needs of\n\nthe person through the provision of less restrictive\n\nalternatives and the alternatives have failed to meet\n\nthe treatment needs of the person, or\n\nb. after a thorough consideration of less restrictive\n\nalternatives to inpatient treatment, the condition of\n\nthe person is such that less restrictive alternatives\n\nare unlikely to meet the treatment needs of the\n\nperson.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2209b866f71d584e375a1e6385ec61d0c887065eeb35c1fbba7ebbd73ff6bd95","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-5-413","next":"us-ok/okla.-stat.-tit.-43a-43a-5-415"},"notice":"GroundRules: Original legal text.
