Sections 5-501 through 5-513 of this title shall be known\n\nand may be cited as the “Inpatient Mental Health and Substance Abuse\n\nTreatment of Minors Act”.\n\nB. The Oklahoma Legislature hereby declares that the public\n\npolicy of this state is to:\n\n1. Assure adequate treatment of minors needing mental health\n\ntreatment or treatment for drug or alcohol abuse;\n\n2. Establish behavioral standards for determination of\n\ndangerousness of persons in need of such treatment;\n\n3. Require the use of the least restrictive alternative in the\n\ndetermination of the method of treatment;\n\n4. Provide orderly and reliable procedures for admission or\n\ncommitment of minors alleged to be in need of inpatient mental\n\nhealth treatment or treatment for drug or alcohol abuse consistent\n\nwith due process of law; and\n\n5. Protect the rights of consumers hospitalized pursuant to\n\nlaw.\n\nC. It is the intent of the Legislature that:\n\n1. Mental health and substance abuse treatment services shall\n\nbe provided in the manner most likely to preserve, support and\n\nstrengthen the family of the minor and to assist the minor and the\n\nfamily of the minor;\n\n2. Minors needing mental health services or substance abuse\n\ntreatment shall, to the maximum extent possible, receive those\n\nservices on an outpatient basis; and\n\n3. Inpatient evaluation and treatment services shall be\n\nutilized only as necessary to preserve the health or safety of the\n\nminor or for the protection of others in the case of a minor who, as\n\na result of a demonstrable mental illness or drug or alcohol\n\ndependence, can be expected to intentionally or unintentionally\n\nseriously and physically injure another person.\n\nD.
