The mental health evaluation of a licensed mental health\n\nprofessional prepared pursuant to Section 5-506 or 5-507 of this\n\ntitle shall include written findings as to whether:\n\n1. The minor appears to be a minor in need of treatment and is\n\nreasonably likely to benefit from treatment;\n\n2. Based upon the following, inpatient treatment is the least\n\nrestrictive alternative that meets the needs of the minor:\n\na. reasonable efforts have been made to provide for the\n\ntreatment needs of the minor through the provision of\n\nless restrictive alternatives and such alternatives\n\nhave failed to meet the treatment needs of the minor,\n\nor\n\nb. after a thorough consideration of less restrictive\n\nalternatives to inpatient treatment, the condition of\n\nthe minor is such that less restrictive alternatives\n\nare unlikely to meet the treatment needs of the minor;\n\nand\n\n3. The minor has been provided with a clinically appropriate\n\nexplanation of the nature and purpose of the treatment.\n\nB. Any mental health evaluation of a minor alleged to be a\n\nminor in need of treatment that recommends that the minor be found\n\nto be eligible for inpatient mental health or substance abuse\n\ntreatment shall be signed by the licensed mental health professional\n\nexamining the minor.\n\nC. The parents, all public agencies, and all providers or\n\nprograms which have treated or are treating the minor shall\n\ncooperate with the person conducting a mental health evaluation for\n\nthe purpose of providing the mental health evaluation to a district\n\nattorney or to a district court and shall promptly deliver, as\n\notherwise provided by law, all records related to the treatment or\n\neducation of the minor.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a4d9647b5953ba5f2c53a308709e9447635fc6f77783b0f6159f6498af5ad408","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-5-507","next":"us-ok/okla.-stat.-tit.-43a-43a-5-509"},"notice":"GroundRules: Original legal text.
