Any person detained or voluntarily or involuntarily\n\ncommitted for treatment pursuant to the provisions of the Mental\n\nHealth Law shall be provided with discharge planning and assistance\n\nby the facility where detained or treated. Discharge planning and\n\nassistance shall include, but not be limited to, the following:\n\n1. Return of all personal possessions to the person, upon\n\ndischarge, except contraband considered illegal; and\n\n2. Transportation assistance.\n\nB. 1. A discharge plan shall be completed for every person to\n\nbe discharged from a facility operated by the Department of Mental\n\nHealth and Substance Abuse Services or an agency which provides\n\nservices pursuant to a contract with the Department.\n\n2. Discharge planning and the discharge plan shall include, but\n\nnot be limited to:\n\na. housing information and referral, a location, approved\n\nby the Department, where the consumer will reside,\n\nprovided, the Department shall give preference to\n\ndischarge to an appropriate verifiable address, and,\n\nas necessary, placement assistance pursuant to Section\n\n7-104 of this title,\n\nb. planning for outpatient treatment, as appropriate,\n\nincluding but not limited to assignment of a case\n\nmanager, an initial appointment for outpatient\n\nservices and a treatment plan. Sufficient medication\n\nto enable the person to be discharged to continue the\n\ncourse of medication prescribed for such person until\n\nsuch appointment shall be provided to the person being\n\ndischarged at the time of discharge, and\n\nc. provision of the information in the discharge plan\n\nrequired by this subsection to the consumer in writing\n\nafter such information has been fully explained to the\n\nperson being discharged. The plan shall be signed by\n\nthe person being discharged and by the person\n\nexplaining the plan upon completion of a verbal\n\nexplanation of such plan and shall be signed in the\n\npresence of a family member of the person being\n\ndischarged, or other person interested in the welfare\n\nof the person being discharged. The original copy of\n\nthe plan shall become a part of the official discharge\n\npapers of the consumer and shall be kept in the\n\npermanent files of the consumer. A copy of the signed\n\ndischarge plan shall be furnished the person being\n\ndischarged.\n\nC. The person designated by the Department may provide a family\n\nmember of the person being discharged, or other person interested in\n\nthe welfare of the person being discharged, with information related\n\nto the discharge plan as necessary, appropriate and in compliance\n\nwith confidentiality requirements to enable said family member or\n\nother person to assist with the implementation of and compliance\n\nwith the treatment plan.\n\nD. If a determination is made that an order for alternative\n\ntreatment is necessary, the executive director or person in charge\n\nof the facility in which the person is receiving inpatient treatment\n\nshall:\n\n1. File or request the filing of a petition as provided by\n\nSection 5-410 or 9-102 of this title requesting the order; or\n\n2.
