Stat. tit. 43A, § 43A-7-106","heading":"Return of property upon death or discharge","body":"When any consumer in any state facility subject to the\n\njurisdiction of the Department of Mental Health and Substance Abuse\n\nServices dies or leaves such facility, all property, including\n\nmoney, belonging to said consumer shall be immediately delivered:\n\n1. To the consumer, if leaving; or\n\n2. To the guardian or next of kin of the consumer, if the\n\nconsumer has died. If the consumer has died and no person is\n\navailable for such delivery, the facility shall notify the guardian\n\nor next of kin of such death and the description of the property on\n\nhand by certified mail at the last-known address of such guardian or\n\nnext of kin.
