The provisions of this section shall not be operative and no\n\npayments shall be made from the Oklahoma National Guard Supplemental\n\nRetirement Pay Revolving Fund created in Section 19 of this act\n\nuntil November 1, 2027.\n\nB. The provisions of this section shall only be applicable to a\n\nmember of the Oklahoma National Guard who has accrued enough service\n\ncredit prior to the effective date of this act in order to retire\n\nfrom the system maintained by the Defense Finance and Accounting\n\nService, or its successor in interest, for the benefit of members of\n\nstate National Guards, but who has not attained the required age\n\nprior to the effective date of this act in order to be paid the full\n\namount of such benefit. No member of the Oklahoma National Guard\n\nshall be eligible to receive a payment pursuant to the provisions of\n\nthis section unless the member has completed twenty-five (25) years\n\nof military service and retires as a member of the Oklahoma National\n\nGuard.\n\nC. The provisions of this section shall not be applicable to\n\nany person who retires with an active duty military pension.\n\nD. The amount of the payment shall be determined as follows:\n\n1. Determine the amount of retirement the member would receive\n\nif the member had reached the age to accrue federal retirement\n\nbenefits;\n\n2. If the members of the active duty military retirement system\n\nwere eligible for a cost-of-living adjustment for the year for which\n\nthe computation of the payment amount authorized by this section is\n\nto be made, the cost-of-living adjustment amount in an annualized\n\nform shall be added to the result of the computation in paragraph 1\n\nof this subsection each year; and\n\n3. The resulting amount shall be paid to the Oklahoma National\n\nGuard member in twelve (12) equal monthly amounts with allowance as\n\nrequired for rounding.\n\nE. Any benefit payable to an eligible member of the Oklahoma\n\nNational Guard shall only be payable during the member's lifetime,\n\nand no benefit authorized pursuant to the provisions of this section\n\nshall be payable to a beneficiary other than amounts paid to a\n\nmember prior to the member's death which are payable to another\n\nperson pursuant to the provisions of a joint tenancy bank account\n\nwith a right of survivorship naming a person or persons as\n\nbeneficiary, a bank account with a transfer on death or payable on\n\ndeath feature, an express trust, including, but not limited to, a\n\ntrust created by the payee member during his or her lifetime, a will\n\nor the statute of intestate succession for distribution of the\n\nassets of a person who does not otherwise provide for the\n\ndisposition of his or her assets after death.\n\nF. The payment otherwise authorized pursuant to the provisions\n\nof this act may only be made to a person who has become eligible to\n\nreceive retirement benefits from the retirement system under the\n\nsupervision of the Defense Finance and Accounting Service, or its\n\nsuccessor in interest, as of the date the first payment pursuant to\n\nthis act is authorized.\n\nG. The payments authorized by this section shall be paid to the\n\neligible member until the member begins to receive federal\n\nretirement benefits from the Defense Finance and Accounting Service,\n\nor its successor in interest, but shall not be paid for any period\n\nof time after such time period.\n\nH. In the event the funds required for full payment to all\n\neligible members pursuant to the provisions of this section are not\n\nsufficient, the payments to the eligible members shall be prorated\n\nby dividing the total number of eligible members by the total amount\n\nof available funds. The resulting quotient shall be multiplied by\n\nthe payment amount otherwise due to the eligible member and the\n\nresult of that computation shall be the reduced dollar amount paid\n\nto each member for the applicable period. For any period of time\nshall be prorated\n\nby dividing the total number of eligible members by the total amount\n\nof available funds.
