A person who is a member of, applies to be a member of,\n\nperforms, has performed, applies to perform, or has an obligation to\n\nperform service in the state military forces shall not be denied\n\ninitial employment, reemployment, retention in employment,\n\npromotion, or any benefit of employment by an employer on the basis\n\nof that membership, application for membership, performance of\n\nservice, application for service, or obligation.\n\nB. An employer shall not discriminate in employment against or\n\ntake any adverse employment action against any person because the\n\nperson:\n\n1. Has taken an action to enforce a protection afforded\n\npursuant to the Oklahoma Uniformed Services Employment and\n\nReemployment Rights Act;\n\n2. Has testified or otherwise made a statement in or in\n\nconnection with any proceeding under the Oklahoma Uniformed Services\n\nEmployment and Reemployment Rights Act;\n\n3. Has assisted or otherwise participated in an investigation\n\nunder the Oklahoma Uniformed Services Employment and Reemployment\n\nRights Act; or\n\n4. Has exercised a right provided for in the Oklahoma Uniformed\n\nServices Employment and Reemployment Rights Act.\n\nThe prohibition in this subsection shall apply with respect to a\n\nperson regardless of whether that person has performed service in\n\nthe state military forces.\n\nC. An employer shall be considered to have engaged in actions\n\nprohibited:\n\n1. Under subsection A of this section if the person's\n\nmembership, application for membership, service, application for\n\nservice, or obligation for service in the state military forces is a\n\nmotivating factor in the employer's action, unless the employer can\n\nprove that the action would have been taken in the absence of such\n\nmembership, application for membership, service, application for\n\nservice, or obligation for service; or\n\n2. Under subsection B of this section if the person's:\n\na. action to enforce a protection afforded any person\n\nunder the Oklahoma Uniformed Services Employment and\n\nReemployment Rights Act,\n\nb. testimony or making of a statement in or in connection\n\nwith any proceeding under the Oklahoma Uniformed\n\nServices Employment and Reemployment Rights Act,\n\nc. assistance or other participation in an investigation\n\nunder the Oklahoma Uniformed Services Employment and\n\nReemployment Rights Act, or\n\nd. exercise of a right provided for in the Oklahoma\n\nUniformed Services Employment and Reemployment Rights\n\nAct,\n\nis a motivating factor in the employer's action, unless the employer\n\ncan prove that the action would have been taken in the absence of\n\nsuch person's enforcement action, testimony, statement, assistance,\n\nparticipation, or exercise of a right.\n\nD.
