Stat. tit. 44, § 44-4314","heading":"Reemployment - Director of Human Capital Management of","body":"the Office of Management and Enterprise Services duties.\n\nA. Except as provided in subsections B, C and D of this\n\nsection, if a person is entitled to reemployment by the state\n\ngovernment under Section 8 of this act, he or she shall be\n\nreemployed in a position of employment as described in Section 9 of\n\nthis act.\n\nB. 1. If the Director of Human Capital Management of the\n\nOffice of Management and Enterprise Services makes a determination\n\ndescribed in paragraph 2 of this subsection with respect to a person\n\nwho was employed by a state agency at the time he or she entered the\n\nstate military forces from which he or she seeks reemployment under\n\nthis section, the Director shall:\n\na. identify a position of like seniority, status, and pay\n\nat another state agency that satisfies the\n\nrequirements of Section 9 of this act and for which\n\nthe person is qualified, and\n\nb. ensure that the person is offered such a position.\n\n2. The Director shall carry out the duties in subparagraphs a\n\nand b of paragraph 1 of this subsection if the Director determines\n\nthat:\n\na. the state agency that employed the person no longer\n\nexists and the functions of the agency have not been\n\ntransferred to another state agency, or\n\nb. it is impossible or unreasonable for the agency to\n\nreemploy the person.\n\nC. If the employer of a person described in subsection A of\n\nthis section was, at the time the person entered the state military\n\nforces from which the person seeks reemployment under this section,\n\na part of the judicial branch or the legislative branch of the state\n\nand the employer determines that it is impossible or unreasonable\n\nfor the employer to reemploy the person, the person shall, upon\n\napplication to the Director of Human Capital Management of the\n\nOffice of Management and Enterprise Services, be ensured an offer of\n\nemployment in an alternative position in a state agency on the basis\n\ndescribed in subsection B of this section.\n\nD. If the Adjutant General determines it is impossible or\n\nunreasonable to reemploy a person who was a National Guard\n\ntechnician employed under 32 U.S.C., Section 709, the person shall,\n\nupon application to the Director of Human Capital Management of the\n\nOffice of Management and Enterprise Services, be ensured an offer of\n\nemployment in an alternative position in a state agency on the basis\n\ndescribed in subsection B of this section.","path":["OK Code","Title 44"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os44.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2d03c607e0fdf2ab680d0988af0a3776aa6a2b573c1f68c3e63d9c1ead242c1d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-44-44-4313","next":"us-ok/okla.-stat.-tit.-44-44-4315"},"notice":"GroundRules: Original legal text.
