The administrator of each state agency or political\n\nsubdivision shall prescribe procedures for ensuring that the rights\n\nunder the Oklahoma Uniformed Services Employment and Reemployment\n\nRights Act apply to the employees of the state agency or political\n\nsubdivision.\n\nB. In prescribing procedures pursuant to subsection A of this\n\nsection, the administrator shall ensure, to the maximum extent\n\npracticable, that the procedures of the state agency or political\n\nsubdivision for reemploying persons who serve in the state military\n\nforces provide for the reemployment of such persons in the state\n\nagency or political subdivision in a manner similar to the manner of\n\nreemployment described in Section 9 of this act.\n\nC. 1. The procedures prescribed in subsection A of this\n\nsection shall designate an employee at the state agency or political\n\nsubdivision who shall determine whether or not the reemployment of a\n\nperson referred to in subsection B of this section by the state\n\nagency or political subdivision is impossible or unreasonable.\n\n2. Upon making a determination that the reemployment is\n\nimpossible or unreasonable, the official designated in paragraph 1\n\nof this subsection shall notify the person seeking reemployment and\n\nthe Director of Human Capital Management of the Office of Management\n\nand Enterprise Services of such determination.\n\n3. A determination made pursuant to this subsection shall not\n\nbe subject to judicial review.\n\n4. The administrator of each state agency or political\n\nsubdivision shall submit to the Committee on Veterans and Military\n\nAffairs of the Oklahoma House of Representatives and the Committee\n\non Veterans and Military Affairs of the Oklahoma State Senate by\n\nDecember 31 of each year a report on the number of persons whose\n\nreemployment with the state agency or political subdivision was\n\ndetermined under this subsection to be impossible or unreasonable\n\nduring the year preceding the report, including the reason for each\n\ndetermination. In the event such determination is not made within\n\nthe preceding reporting period, no report shall be required pursuant\n\nto this paragraph.\n\nD. 1. Except as provided in this section, nothing in this\n\nsection or Section 9 of this act shall be construed to exempt any\n\nstate agency or political subdivision referred to in subsection A of\n\nthis section from compliance with any other substantive provision of\n\nthe Oklahoma Uniformed Services Employment and Reemployment Rights\n\nAct.\n\n2. This section shall not be construed as prohibiting:\n\na. an employee of a state agency or political subdivision\n\nfrom seeking information from the Commissioner of\n\nLabor regarding assistance in pursuing reemployment\n\nfrom the state agency or political subdivision under\n\nthe Oklahoma Uniformed Services Employment and\n\nReemployment Rights Act, alternative employment in the\n\nstate government under the Oklahoma Uniformed Services\n\nEmployment and Reemployment Rights Act, or information\n\nrelating to the rights and obligations of employees\n\nand state agencies, political subdivisions or their\n\ninstrumentalities under the Oklahoma Uniformed\n\nServices Employment and Reemployment Rights Act, or\n\nb. such a state agency or political subdivision from\n\nvoluntarily cooperating with or seeking assistance in\n\nor clarification from the Commissioner of Labor or the\n\nDirector of Human Capital Management of the Office of\n\nManagement and Enterprise Services for any matter\n\narising under the Oklahoma Uniformed Services\n\nEmployment and Reemployment Rights Act.\n\nE. The Director of Human Capital Management of the Office of\n\nManagement and Enterprise Services shall ensure the offer of\n\nemployment to a person in a position in a state agency on the basis\n\ndescribed in subsection B of this section if:\n\n1. The person was an employee of a state agency or political\n\nsubdivision at the time he or she entered the state military forces\nand Reemployment Rights Act.\n\nE. The Director of Human Capital Management of the Office of\n\nManagement and Enterprise Services shall ensure the offer of\n\nemployment to a person in a position in a state agency on the basis\n\ndescribed in subsection B of this section if:\n\n1. The person was an employee of a state agency or political\n\nsubdivision at the time he or she entered the state military forces\n\nfrom which the person seeks reemployment under this section;\n\n2. The appropriate officer of the state agency or political\n\nsubdivision determines under subsection C of this section that\n\nreemployment of the person by the state agency or political\n\nsubdivision is impossible or unreasonable; and\n\n3.
