A person who claims that:\n\n1. He or she is entitled under the Oklahoma Uniformed Services\n\nEmployment and Reemployment Rights Act to employment or reemployment\n\nrights or benefits with respect to employment; and\n\n2. a. His or her employer has failed or refused, or is about\n\nto fail or refuse, to comply with the provisions of\n\nthe Oklahoma Uniformed Services Employment and\n\nReemployment Rights Act, or\n\nb. His or her employer is a state agency and the employer\n\nor the Office of Management and Enterprise Services,\n\nHuman Capital Management, has failed or refused, or is\n\nabout to fail or refuse, to comply with the provisions\n\nof the Oklahoma Uniformed Services Employment and\n\nReemployment Rights Act,\n\nmay file a complaint with the Commissioner of Labor as provided in\n\nsubsection B of this section, and the Commissioner shall investigate\n\nsuch complaint.\n\nB. The complaint shall be in writing on a form prescribed by\n\nthe Commissioner, include the name and address of the employer\n\nagainst whom the complaint is filed, and contain a summary of the\n\nallegations that form the basis for the complaint.\n\nC. 1. Not later than five (5) business days after the\n\nCommissioner receives a complaint submitted pursuant to this\n\nsection, the Commissioner shall notify the complainant in writing of\n\nhis or her rights with respect to the complaint under this section\n\nand Section 17 of this act.\n\n2. The Commissioner shall, upon request, provide technical\n\nassistance to a potential complainant for a complaint under this\n\nsubsection and, when appropriate, to the complainant's employer.\n\nD. The Commissioner shall investigate each complaint submitted\n\npursuant to this section. If the Commissioner determines as a\n\nresult of the investigation that the action alleged in the complaint\n\noccurred, the Commissioner shall attempt to resolve the complaint by\n\nmaking reasonable efforts to ensure that the employer named in the\n\ncomplaint complies with the provisions of the Oklahoma Uniformed\n\nServices Employment and Reemployment Rights Act.\n\nE. If the efforts of the Commissioner do not resolve the\n\ncomplaint, the Commissioner shall notify the complainant in writing\n\nof:\n\n1. The results of the Commissioner's investigation; and\n\n2. The complainant's entitlement to proceed under the\n\nenforcement of rights provisions in Section 17 of this act for a\n\ncomplainant against a state or private employer.\n\nF.
