Effect of noncompliance of state officials with deadlines.\n\n1. The inability of the Commissioner of Labor or a district\n\nattorney to comply with a deadline applicable to such official under\n\nSection 16 or 17 of this act shall not:\n\na. affect the authority of the district attorney to\n\nrepresent and file an action or submit a complaint on\n\nbehalf of a person under Section 17 of this act,\n\nb. affect the right of a person to:\n\n(1) commence an action under Section 17 of this act,\n\nor\n\n(2) obtain any type of assistance or relief\n\nauthorized by the Oklahoma Uniformed Services\n\nEmployment and Reemployment Rights Act,\n\nc. deprive a district court of jurisdiction over an\n\naction or complaint filed by the district attorney or\n\na person under Section 17 of this act, and\n\nd. constitute a defense, including a statute of\n\nlimitations period, that any employer, including state\n\ngovernment, its political subdivisions or a private\n\nemployer, may raise in an action filed by the district\n\nattorney or a person under Section 17 of this act.\n\n2. If the Commissioner or the district attorney is unable to\n\nmeet a deadline applicable to such official in Section 16 or 17 of\n\nthis act, and the complainant agrees to an extension of time, the\n\nCommissioner or the district attorney shall complete the required\n\naction within the additional period of time agreed to by the\n\ncomplainant.\n\nB. Inapplicability of statutes of limitations.
