Stat. tit. 44, § 44-47","heading":"Period of enlistment - Qualifications - Reenlistment - Oath","body":"- Relinquishment of custody of minor child.\n\nA. Enlistments in the National Guard. Hereafter, the period of\n\nenlistment in the National Guard of this state shall be for three\n\n(3) years or such other time as prescribed by National Guard\n\nregulations, and the qualifications for enlistment shall be the same\n\nas those prescribed for admission to the Regular Army or Regular Air\n\nForce or National Guard regulations; provided that the privilege of\n\ncontinuing in active service during the whole of an enlistment\n\nperiod and of reenlisting in the said service shall not be denied\n\nexcept as herein otherwise provided. Unless otherwise prohibited by\n\nfederal law or by Department of Army, Department of Air Force or\n\nNational Guard Bureau regulations, enlisted members and prospective\n\nmembers of the Oklahoma Army and Air National Guard who have\n\nsuccessfully completed the requirements for and have obtained a\n\nGeneral Education Diploma (G.E.D.) shall be awarded a high school\n\ndiploma by the State of Oklahoma. The State Department of Education\n\nshall issue this high school diploma. Such diploma shall be limited\n\nto the purposes of enlistment and admission in the National Guard\n\npursuant to the provisions of this section. Such purpose shall be\n\nspecified on the high school diploma. All enlisted men of the\n\nNational Guard of this state shall sign an enlistment contract and\n\ntake and subscribe to the oath required by National Guard\n\nregulations. Any officer or warrant officer of the Armed Forces of\n\nthe United States may administer the enlistment oath.\n\nB. 1. By complying with this subsection, a single custodial\n\nparent who is an applicant for enlistment in the Oklahoma National\n\nGuard satisfies the requirements of National Guard Regulation 600-\n\n200 or Air National Guard Regulation 39-09 regarding the placement\n\nof the physical custody of a minor child with an adult blood\n\nrelative of the child within the third degree of consanguinity for\n\nall periods of active duty during the term of enlistment. A\n\ndocument placing the physical custody of a child pursuant to this\n\nsubsection shall:\n\na. be in writing,\n\nb. clearly identify the child, the person with whom\n\nphysical custody is being placed, that person's\n\nrelationship to the child, and the period of\n\nenlistment for which physical custody is to be placed,\n\nc. be executed by the parent/applicant before a notary\n\npublic, and\n\nd. clearly state that it is for all purposes, including\n\nhealth care, during the periods of time in question.\n\n2. A certified copy or executed copy of the document required\n\nby this subsection shall become a part of the applicant's permanent\n\nOklahoma National Guard file.\n\n3. Nothing in this section shall terminate, interfere, delay or\n\nnegate any right of visitation by the noncustodial parent, or any\n\nperson granted visitation by court order.\n\n4. It is the intent of the Legislature that the placement of\n\nphysical custody of a child pursuant to the provisions of this\n\nsection shall not be a substantial change to any existing custody\n\ndecree nor shall it be deemed a voluntary permanent relinquishment\n\nof custody.","path":["OK Code","Title 44"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os44.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cf4fd96f985629d52b11eae0d2bbcdd9c89be38f99690294f8dfb7c94f5e194a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-44-44-45","next":"us-ok/okla.-stat.-tit.-44-44-48"},"notice":"GroundRules: Original legal text.
