Designation of State Judge Advocate and senior force\n\ncomponent judge advocate. The Adjutant General shall designate in\n\nwriting a State Judge Advocate from among the judge advocates duly\n\ncommissioned in the state military forces. Regardless of rank, the\n\nState Judge Advocate shall be considered the senior force component\n\njudge advocate in the force component of which he or she is a\n\nmember. Unless such authority is delegated in accordance with\n\nsubsection B or C of Section 25 of this title, the Adjutant General\n\nshall also designate in writing a senior force component judge\n\nadvocate in the military force component of which the judge advocate\n\ndesignated as the State Judge Advocate is not a member.\n\nB. Inspections. The senior force component judge advocates in\n\neach of the state's military force components or those judge\n\nadvocates' delegates shall make frequent inspections in the field in\n\nsupervision of the administration of military justice in that force\n\ncomponent.\n\nC. Communication. Convening authorities shall at all times\n\ncommunicate directly with their judge advocates in matters relating\n\nto the administration of military justice. The judge advocate of\n\nany command is entitled to communicate directly with the judge\n\nadvocate of a superior or subordinate command, or with the State\n\nJudge Advocate.\n\nD. Limitations due to prior capacity. No person who, with\n\nrespect to a case, serves in a capacity specified in subsection E of\n\nthis section may later serve as a judge advocate to any reviewing or\n\nconvening authority upon the same case.\n\nE. Conflicts of interest. The capacities referred to in\n\nsubsection D of this section are, with respect to the case involved,\n\nany of the following:\n\n1. Preliminary hearing officer, court member, military trial\n\njudge, military magistrate, or appellate military judge; or\n\n2. Counsel who have acted in the same case or appeared in any\n\nproceeding before a military trial judge, preliminary hearing\n\nofficer, or appellate court.\n\nF. Duties. The senior force component judge advocate of each\n\nforce component within the state military forces shall oversee the\n\nfollowing functions among the judge advocates and paralegals in\n\ntheir respective force components:\n\n1. Recruitment and accession of new recruits;\n\n2. Retention;\n\n3. Education and training;\n\n4. Career development and progression; and\n\n5. Decoration.\n\nG. Assignment of legal personnel. The senior force component\n\njudge advocate of each force component within the state military\n\nforces shall determine the place of duty and frequency of\n\nreassignment among the major commands in their respective force\n\ncomponents for each judge advocate and paralegal.\n\nH. Legal counsel. The State Judge Advocate shall provide legal\n\ncounsel to the Adjutant General and, as requested, to the other\n\nsenior leaders of the state military forces.
