Courts-martial classified.\n\nA. The three kinds of courts-martial in the state military\n\nforces are the following:\n\n1. General courts-martial, as described in subsection B of this\n\nsection;\n\n2. Special courts-martial, as described in subsection C of this\n\nsection; and\n\n3. Summary courts-martial, as described in subsection D of this\n\nsection.\n\nB. General courts-martial. General courts-martial are of the\n\nfollowing two types:\n\n1. A general court-martial consisting of a military judge and\n\neight members, subject to paragraph 3 of subsection E of Section 825\n\nand Section 829 of this title (Article 25, subsection E, paragraph\n\n3, and Article 29); and\n\n2. A general court-martial consisting of a military judge\n\nalone, if, before the court is assembled, the accused, knowing the\n\nidentity of the military judge and after consultation with defense\n\ncounsel, requests, orally on the record or in writing, a court\n\ncomposed of a military judge alone and the military judge approves\n\nthe request.\n\nC. Special courts-martial. Special courts-martial are of the\n\nfollowing two types:\n\n1. A special court-martial consisting of a military judge and\n\nfour members, subject to paragraph 3 of subsection E of Section 825\n\nand Section 829 of this title (Article 25, subsection E, paragraph\n\n3, and Article 29); and\n\n2. A special court-martial consisting of a military judge\n\nalone:\n\na. if the case is so referred by the convening authority,\n\nsubject to Section 819 of this title (Article 19) and\n\nsuch limitations as may be prescribed by regulations\n\npromulgated by the Adjutant General, or\n\nb. if the case is referred under paragraph 1 of this\n\nsubsection and, before the court is assembled, the\n\naccused, knowing the identity of the military judge\n\nand after consultation with defense counsel, requests,\n\norally on the record or in writing, a court composed\n\nof a military judge alone and the military judge\n\napproves the request.\n\nD. Summary court-martial.
