Assembly and impaneling of members; detail of new\n\nmembers and military judges.\n\nA. The military judge shall announce the assembly of a general\n\nor special court-martial with members. After such a court-martial\n\nis assembled, no member may be absent, unless the member is excused:\n\n1. As a result of a challenge;\n\n2. Under subparagraph b of paragraph 1 of subsection B of this\n\nsection; or\n\n3. By order of the military judge or the convening authority\n\nfor disability or other good cause.\n\nB. 1. Under rules promulgated by the Adjutant General, the\n\nmilitary judge of a general or special court-martial with members\n\nshall:\n\na. after determination of challenges, impanel the court-\n\nmartial, and\n\nb. excuse the members who, having been assembled, are not\n\nimpaneled.\n\n2. In a general court-martial, the military judge shall impanel\n\neight members.\n\n3. In a special court-martial, the military judge shall impanel\n\nfour members.\n\nC. In addition to members specified in subsection B of this\n\nsection, the military judge shall impanel alternate members, if the\n\nconvening authority authorizes alternate members.\n\nD. 1. If, after members are impaneled, the membership of the\n\ncourt-martial is reduced to:\n\na. fewer than six members with respect to a general\n\ncourt-martial, or\n\nb. fewer than four members with respect to a special\n\ncourt-martial,\n\nthe trial may not proceed unless the convening authority details new\n\nmembers and, from among the members so detailed, the military judge\n\nimpanels new members sufficient in number to provide the membership\n\nspecified in paragraph 2 of this subsection.\n\n2. The membership referred to in paragraph 1 of this subsection\n\nis as follows:\n\na. at least six but not more than eight members with\n\nrespect to a general court-martial, and\n\nb. four members with respect to a special court-martial.\n\nE. If the military judge is unable to proceed with the trial\n\nbecause of disability or otherwise, a new military judge shall be\n\ndetailed to the court-martial.\n\nF. 1. In the case of new members detailed under subsection D\n\nof this section, the trial may proceed with the new members present\n\nafter the evidence previously introduced is read or, in the case of\n\naudiotape, videotape, or similar recording, is played, in the\n\npresence of the new members, the military judge, the accused, and\n\ncounsel for both sides.\n\n2.
