Certain proceedings conducted before referral.\n\nA. In general.\n\n1. Proceedings may be conducted to review or otherwise act on\n\nthe following matters before referral of charges and specifications\n\nto court-martial for trial in accordance with regulations\n\npromulgated by the Adjutant General:\n\na. prereferral investigative subpoenas,\n\nb. prereferral warrants or orders for electronic\n\ncommunications, and\n\nc. prereferral matters under subsection D of Section 806B\n\nof Title 44 of the Oklahoma Statutes (Article 6B,\n\nsubsection D).\n\n2. The regulations promulgated under paragraph 1 of this\n\nsubsection shall:\n\na. include procedures for the review of such rulings that\n\nmay be ordered under this section as the Adjutant\n\nGeneral considers appropriate, and\n\nb. provide such limitations on the relief that may be\n\nordered under this section as the Adjutant General\n\nconsiders appropriate.\n\n3. If any matter in a proceeding under this section becomes a\n\nsubject at issue with respect to charges that have been referred to\n\na general or special court-martial, the matter shall be transferred\n\nto the military trial judge detailed to the court-martial.\n\nB. Detail of military trial judge. The Adjutant General shall\n\npromulgate regulations providing for the manner in which military\n\ntrial judges are detailed to proceedings under subsection A of this\n\nsection.\n\nC. Detail or employment of military magistrate.
