Service of charges; commencement of trial.\n\nA. In general. Trial counsel detailed for a court-martial\n\nunder Section 827 of this title (Article 27) shall cause to be\n\nserved upon the accused a copy of the charges and specifications\n\nreferred for trial.\n\nB. Commencement of trial.\n\n1. Subject to paragraph 2 of this subsection, no trial or other\n\nproceeding of a general court-martial or a special court-martial,\n\nincluding any session under subsection A of Section 839 of this\n\ntitle (Article 39, subsection A) may be held over the objection of\n\nthe accused:\n\na. with respect to a general court-martial, from the time\n\nof service through the fifth day after the date of\n\nservice, or\n\nb. with respect to a special court-martial, from the time\n\nof service through the third day after the date of\n\nservice.\n\n2. An objection under paragraph 1 of this subsection may be\n\nraised only at the first session of the trial or other proceeding\n\nand only if the first session occurs before the end of the\n\napplicable periods under subparagraph a or b of paragraph 1 of this\n\nsubsection. If the first session occurs before the end of the\n\napplicable period, the military judge shall, at that session,\n\ninquire as to whether the defense objects under this subsection.\n\nC. Continuances.
