With respect to any proceeding under the Oklahoma Uniform\n\nCode of Military Justice, a judicial officer specified in paragraph\n\n2 of this subsection may punish for contempt any person who:\n\na. uses any menacing word, sign, or gesture in the\n\npresence of the judicial officer during the\n\nproceeding,\n\nb. disturbs the proceeding by any riot or disorder, or\n\nc. willfully disobeys a lawful writ, process, order,\n\nrule, decree, or command issued with respect to the\n\nproceeding.\n\n2. A judicial officer referred to in paragraph 1 of this\n\nsubsection is any of the following:\n\na. any military trial judge detailed to a court-martial,\n\nb. any military magistrate detailed or retained to\n\nconduct prereferral proceedings under subsection D of\n\nSection 806B of this title (Article 6B, subsection D)\n\nor subparagraph a of paragraph 1 of subsection A of\n\nSection 17 of this act (Article 30A, subsection A,\n\nparagraph 1, subparagraph a) or appellate proceedings\n\nunder paragraph 3 of subsection J of Section 866 of\n\nthis title (Article 66, subsection J, paragraph 3),\n\nc. the chief judge of the Military Court of Appeals, or\n\nd. the president of a court of inquiry.\n\nB. Opportunity to be heard and warning. A judicial officer, as\n\nspecified in paragraph 2 of subsection A of this section, may punish\n\na person cited for contempt after an opportunity to be heard has\n\nbeen given. Censure shall be imposed by the judicial officer only\n\nif:\n\n1. It is clear from the identity of the offender and the\n\ncharacter of his or her acts that disruptive conduct is willfully\n\ncontemptuous; or\n\n2. The conduct warranting the sanction is preceded by a clear\n\nwarning that the conduct is impermissible and that specified\n\nsanctions may be imposed for its repetition.\n\nC. Notification of contempt proceedings. The judicial officer,\n\nas specified in paragraph 2 of subsection A of this section, as soon\n\nas practicable after he or she is satisfied that courtroom\n\nmisconduct requires contempt proceedings, should inform the alleged\n\noffender of his or her intention to institute said proceedings.\n\nD. Notice and opportunity to provide evidence or testimony.\n\nBefore imposing any punishment for contempt, the judicial officer\n\nshall give the offender notice of the charges and an opportunity to\n\nadduce evidence or argument relevant to guilt or punishment.\n\nE. Imposition of sanctions. The judicial officer before whom\n\nthe misconduct occurs may impose appropriate sanctions including\n\npunishment for contempt.\n\nF. Punishment. The punishment for contempt under subsection A\n\nof this section shall not exceed the punishments provided in\n\nsubsection A of Section 566 of Title 21 of the Oklahoma Statutes.\n\nG. Review. A punishment under this section:\n\n1. If imposed by a military trial judge, may be reviewed by the\n\nMilitary Court of Appeals in accordance with the uniform rules of\n\nprocedure for the Military Court of Appeals under subsection L of\n\nSection 866 of this title (Article 66, subsection L);\n\n2. If imposed by the chief judge of the Military Court of\n\nAppeals, shall constitute a judgment of the court, subject to review\n\nunder the applicable provisions of Section 867 of this title\n\n(Article 67); and\n\n3.
