Subject to paragraph 2 of this subsection, a convening\n\nauthority or a military judge may order depositions at the request\n\nof any party.\n\n2. A deposition may be ordered under paragraph 1 of this\n\nsubsection only if the requesting party demonstrates that, due to\n\nexceptional circumstances, it is in the interest of justice that the\n\ntestimony of a prospective witness be preserved for use at a court-\n\nmartial or court of inquiry.\n\n3. A party who requests a deposition under this section shall\n\ngive to every other party reasonable written notice of the time and\n\nplace for the deposition.\n\n4. A deposition under this section shall be taken before, and\n\nauthenticated by, an impartial officer, as follows:\n\na. whenever practicable, by an impartial judge advocate\n\ncertified under subsection B of Section 827 of this\n\ntitle (Article 27, subsection B), and\n\nb. in exceptional circumstances, by an impartial military\n\nor civil officer authorized to administer oaths by:\n\n(1) the laws of the United States, or\n\n(2) the laws of the place where the deposition is\n\ntaken.\n\nB. Representation by counsel. Representation of the parties\n\nwith respect to a deposition shall be by counsel detailed in the\n\nsame manner as trial counsel and defense counsel are detailed under\n\nSection 827 of this title (Article 27). In addition, the accused\n\nshall have the right to be represented by civilian or military\n\ncounsel in the same manner as such counsel is provided for in\n\nsubsection B of Section 838 of this title (Article 38, subsection\n\nB).\n\nC. Admissibility and use as evidence. A deposition order under\n\nsubsection A of this section does not control the admissibility of\n\nthe deposition in a court-martial or other proceeding under the\n\nOklahoma Uniform Code of Military Justice.
