Admissibility of sworn testimony from records of\n\ncourts of inquiry.\n\nA. Use as evidence by any party. In any case not extending to\n\nthe dismissal of a commissioned officer, the sworn testimony,\n\ncontained in the duly authenticated record of proceedings of a court\n\nof inquiry, of a person whose oral testimony cannot be obtained,\n\nmay, if otherwise admissible under the rules of evidence, be read in\n\nevidence by any party before a court-martial if the accused was a\n\nparty before the court of inquiry and if the same issue was involved\n\nor if the accused consents to the introduction of such evidence.\n\nB. Use as evidence by defense. Such testimony may be read in\n\nevidence only by the defense in cases extending to the dismissal of\n\na commissioned officer.\n\nC. Use in courts of inquiry and military boards. Such\n\ntestimony may also be read in evidence before a court of inquiry or\n\nan administrative board.\n\nD. Audiotape or videotape. Sworn testimony that:\n\n1. Is recorded by audiotape, videotape, or similar method; and\n\n2.
