Lack of mental capacity or mental responsibility.\n\nA. No person accused of violating a punitive section under the\n\nOklahoma Uniform Code of Military Justice shall be brought to trial\n\nby a general or special court-martial if that person is presently\n\nsuffering from a mental disease or defect rendering him or her\n\nmentally incompetent to the extent that he or she is unable to\n\nunderstand the nature of the proceedings against him or her or to\n\nconduct or cooperate intelligently in the defense of the case.\n\nB. A person is presumed to have the capacity to stand trial\n\nunless the contrary is established.\n\nC.
