Any member of the state military forces who:\n\n1. Without authority goes or remains absent from his or her\n\nunit, organization, or place of duty with intent to remain away\n\ntherefrom permanently;\n\n2. Quits his or her unit, organization, or place of duty with\n\nintent to avoid hazardous duty or to shirk important service; or\n\n3. Without being regularly separated from one of the force\n\ncomponents of state military forces enlists or accepts an\n\nappointment in the same or another one of the armed forces without\n\nfully disclosing the fact that he or she has not been regularly\n\nseparated, or enters any foreign armed service except when\n\nauthorized by the United States,\n\nis guilty of desertion.\n\nB. Any commissioned officer of the state military forces who,\n\nafter tender of his or her resignation and before notice of its\n\nacceptance, quits his or her post or proper duties without leave and\n\nwith intent to remain away therefrom permanently is guilty of\n\ndesertion.\n\nC.
