Prohibited activities with military recruit or\n\ntrainee by person in position of special trust.\n\nA. Abuse of training leadership position. Any person subject\n\nto the Oklahoma Uniform Code of Military Justice:\n\n1. Who is an officer, or a noncommissioned officer;\n\n2. Who is in a training leadership position with respect to a\n\nspecially protected junior member of the state military forces; and\n\n3. Who engages in prohibited sexual activity with such\n\nspecially protected junior member of the state military forces,\n\nshall be punished as a court-martial may direct.\n\nB. Abuse of position as military recruiter. Any person subject\n\nto the Code:\n\n1. Who is a military recruiter and engages in prohibited sexual\n\nactivity with an applicant for military service; or\n\n2. Who is a military recruiter and engages in prohibited sexual\n\nactivity with a specially protected junior member of the state\n\nmilitary forces who is enlisted under a delayed entry program,\n\nshall be punished as a court-martial may direct.\n\nC. Consent. Consent is not a defense for any conduct at issue\n\nin a prosecution under this section (article).\n\nD. Definitions. In this section (article):\n\n1. Specially protected junior member of the state military\n\nforces. The term \"specially protected junior member of the state\n\nmilitary forces\" means:\n\na. a member of the state military forces who is assigned\n\nto, or is awaiting assignment to, basic training or\n\nother initial active duty for training, including a\n\nmember who is enlisted under a delayed entry program,\n\nb. a member of the state military forces who is a cadet,\n\nan officer candidate, or a student in any other\n\nofficer qualification program, and\n\nc. a member of the state military forces in any program\n\nthat, by regulation prescribed by the Secretary of the\n\nArmy or the Secretary of the Air Force or the Adjutant\n\nGeneral, is identified as a training program for\n\ninitial career qualification;\n\n2. Training leadership position. The term \"training leadership\n\nposition\" means, with respect to a specially protected junior member\n\nof the state military forces, any of the following:\n\na. any drill instructor position or other leadership\n\nposition in a basic training program, an officer\n\ncandidate school, a reserve officers' training corps\n\nunit, a training program for entry into the state\n\nmilitary forces, or any program that, by regulation\n\nprescribed by the Secretary of the Army or the\n\nSecretary of the Air Force or the Adjutant General,\n\nand\n\nb. faculty and staff of any officer candidate school\n\norganized under the authority of the Adjutant General;\n\n3. Applicant for military service. The term \"applicant for\n\nmilitary service\" means a person who, under regulations prescribed\n\nby the Secretary of the Army or the Secretary of the Air Force or\n\nthe Adjutant General, is an applicant for original enlistment or\n\nappointment in the state military forces;\n\n4. Military recruiter. The term \"military recruiter\" means a\n\nperson who, under regulations prescribed by the Secretary of the\n\nArmy or the Secretary of the Air Force or the Adjutant General, has\n\nthe primary duty to recruit persons for service in the state\n\nmilitary forces; and\n\n5. Prohibited sexual activity.
