Prohibition. Any person subject to the Oklahoma Uniform\n\nCode of Military Justice:\n\n1. Who knowingly and wrongfully broadcasts or distributes an\n\nintimate visual image of another person or a visual image of\n\nsexually explicit conduct involving a person who:\n\na. is at least eighteen (18) years of age at the time the\n\nintimate visual image or visual image of sexually\n\nexplicit conduct was created,\n\nb. is identifiable from the intimate visual image or\n\nvisual image of sexually explicit conduct itself, or\n\nfrom information displayed in connection with the\n\nintimate visual image or visual image of sexually\n\nexplicit conduct, and\n\nc. does not explicitly consent to the broadcast or\n\ndistribution of the intimate visual image or visual\n\nimage of sexually explicit conduct;\n\n2. Who knows or reasonably should have known that the intimate\n\nvisual image or visual image of sexually explicit conduct was made\n\nunder circumstances in which the person depicted in the intimate\n\nvisual image or visual image of sexually explicit conduct retained a\n\nreasonable expectation of privacy regarding any broadcast or\n\ndistribution of the intimate visual image or visual image of\n\nsexually explicit conduct;\n\n3. Who knows or reasonably should have known that the broadcast\n\nor distribution of the intimate visual image or visual image of\n\nsexually explicit conduct is likely:\n\na. to cause harm, harassment, intimidation, emotional\n\ndistress, or financial loss for the person depicted in\n\nthe intimate visual image or visual image of sexually\n\nexplicit conduct, or\n\nb. to harm substantially the depicted person with respect\n\nto that person's health, safety, business, calling,\n\ncareer, financial condition, reputation, or personal\n\nrelationships; and\n\n4. Whose conduct, under the circumstances, had a reasonably\n\ndirect and palpable connection to a military mission or military\n\nenvironment,\n\nis guilty of wrongful distribution of intimate visual images or\n\nvisual images of sexually explicit conduct and shall be punished as\n\na court-martial may direct.\n\nB. Definitions. In this section:\n\n1. Broadcast. The term \"broadcast\" means to electronically\n\ntransmit a visual image with the intent that it be viewed by a\n\nperson or persons;\n\n2. Distribute. The term \"distribute\" means to deliver to the\n\nactual or constructive possession of another person, including\n\ntransmission by mail or electronic means;\n\n3. Intimate visual image. The term \"intimate visual image\"\n\nmeans a visual image that depicts a private area of a person;\n\n4. Private area. The term \"private area\" means the naked or\n\nunderwear-clad genitalia, anus, buttocks, or female areola or\n\nnipple;\n\n5. Reasonable expectation of privacy. The term \"reasonable\n\nexpectation of privacy\" means circumstances in which a reasonable\n\nperson would believe that a private area of the person, or sexually\n\nexplicit conduct involving the person, would not be visible to the\n\npublic;\n\n6. Sexually explicit conduct. The term \"sexually explicit\n\nconduct\" means actual or simulated genital-genital contact, oral-\n\ngenital contact, anal-genital contact, or oral-anal contact, whether\n\nbetween persons of the same or opposite sex, bestiality,\n\nmasturbation, or sadistic or masochistic abuse; and\n\n7. Visual image.
