Other sexual misconduct.\n\nA. Indecent viewing, visual recording, or broadcasting. Any\n\nperson subject to the Oklahoma Uniform Code of Military Justice who,\n\nwithout legal justification or lawful authorization:\n\n1. Knowingly and wrongfully views the private area of another\n\nperson, without that other person's consent and under circumstances\n\nin which that other person has a reasonable expectation of privacy;\n\n2. Knowingly photographs, videotapes, films, or records by any\n\nmeans the private area of another person, without that other\n\nperson's consent and under circumstances in which that other person\n\nhas a reasonable expectation of privacy; or\n\n3. Knowingly broadcasts or distributes any such recording that\n\nthe person knew or reasonably should have known was made under the\n\ncircumstances proscribed in paragraphs 1 and 2 of this subsection,\n\nis guilty of an offense under this section and shall be punished as\n\na court-martial may direct.\n\nB. Forcible pandering. Any person subject to the Code who\n\ncompels another person to engage in an act of prostitution with any\n\nperson is guilty of forcible pandering and shall be punished as a\n\ncourt-martial may direct.\n\nC. Indecent exposure. Any person subject to the Code who\n\nintentionally exposes, in an indecent manner, the genitalia, anus,\n\nbuttocks, or female areola or nipple is guilty of indecent exposure\n\nand shall by punished as a court-martial may direct.\n\nD. Definitions. In this section:\n\n1. Act of prostitution. The term \"act of prostitution\" means a\n\nsexual act or sexual contact, as defined in subsection F of Section\n\n920 of this title (Article 120, subsection F), on account of which\n\nanything of value is given to, or received by, any person;\n\n2. Private area. The term \"private area\" means the naked or\n\nunderwear-clad genitalia, anus, buttocks, or female areola or\n\nnipple;\n\n3. Reasonable expectation of privacy. The term \"under\n\ncircumstances in which that other person has a reasonable\n\nexpectation of privacy\" means:\n\na. circumstances in which a reasonable person would\n\nbelieve that he or she could disrobe in privacy,\n\nwithout being concerned that an image of a private\n\narea of the person was being captured, or\n\nb. circumstances in which a reasonable person would\n\nbelieve that a private area of the person would not be\n\nvisible to the public;\n\n4. Broadcast. The term \"broadcast\" means to electronically\n\ntransmit a visual image with the intent that it be viewed by a\n\nperson or persons;\n\n5. Distribute. The term \"distribute\" means delivering to the\n\nactual or constructive possession of another, including transmission\n\nby electronic means;\n\n6. Indecent manner.
