Any person subject to the Oklahoma Uniform Code\n\nof Military Justice who, with the intent to retaliate against any\n\nperson for reporting or planning to report a criminal offense, or\n\nmaking or planning to make a protected communication, or with the\n\nintent to discourage any person from reporting a criminal offense or\n\nmaking or planning to make a protected communication:\n\n1. Wrongfully takes or threatens to take an adverse personnel\n\naction against any person; or\n\n2. Wrongfully withholds or threatens to withhold a favorable\n\npersonnel action with respect to any person,\n\nshall be punished as a court-martial may direct.\n\nB. Definitions. In this section:\n\n1. The term \"protected communication\" means the following:\n\na. a lawful communication to a Member of Congress or a\n\nMember of the Oklahoma Legislature or an Inspector\n\nGeneral, and\n\nb. a communication to a covered individual or\n\norganization in which a member of the state military\n\nforces complains of, or discloses information that the\n\nmember reasonably believes constitutes evidence of,\n\nany of the following:\n\n(1) a violation of law or regulation, including a law\n\nor regulation prohibiting sexual harassment or\n\nunlawful discrimination, or\n\n(2) gross mismanagement, a gross waste of funds, an\n\nabuse of authority, or a substantial and specific\n\ndanger to public health or safety;\n\n2. The term \"Inspector General\" has the meaning given that term\n\nin Section 1034(j) of Title 10 of the United States Code;\n\n3. The term \"covered individual or organization\" means any\n\nrecipient of a communication specified in clauses (i) through (v) of\n\nSection 1034(b)(1)(B) of Title 10 of the United States Code; and\n\n4.
