Continuances for military service.\n\nA. It shall be the duty of any justice, judge, judicial\n\nreferee, corporation commissioner, administrative law judge or\n\nhearing officer presiding over any civil, criminal or administrative\n\nproceeding in this state to continue any trial, hearing or other\n\naction pending before the court or an administrative forum when a\n\nparty to the pending action or the primary counsel representing a\n\nparty to the pending action is not present at the time the case or\n\nmatter in question is reached on the docket or schedule by reason of\n\nparticipation in:\n\n1. Active federal service, as defined in Title 10 of the United\n\nStates Code;\n\n2. Title 32 active duty, as defined in Section 801 of this\n\ntitle (Article 1);\n\n3. Service in other reserve components of the Armed Forces of\n\nthe United States, as defined in Title 10 of the United States Code;\n\nor\n\n4. State active duty, as defined in Section 801 of this title\n\n(Article 1).\n\nB. The trial, hearing or other pending action may proceed if\n\nthe party, without the presence of his or her primary counsel, or\n\nthe primary counsel, without the presence of the party, declares\n\nthat the case or matter in question is nevertheless ready to proceed\n\nat the scheduled time.\n\nC. If the primary counsel of a party to the pending action is\n\nnot present due to military service pursuant to subsection A of this\n\nsection, the party so affected shall declare under oath that he or\n\nshe cannot properly proceed with the trial, hearing or other action\n\npending before the court or administrative forum without the\n\npresence of the primary counsel.\n\nD. If a party to the pending action is not present due to\n\nmilitary service pursuant to subsection A of this section, his or\n\nher legal counsel shall appear and shall state in his or her place\n\nthat the case or matter in question cannot properly proceed without\n\nthe presence of the absent party.\n\nE. Continuances granted pursuant to this section shall remain\n\nin effect no longer than ninety (90) calendar days. The justice,\n\njudge, judicial referee, corporation commissioner, administrative\n\nlaw judge or hearing officer may, at his or her discretion, continue\n\nthe proceeding in question in order to carry out the administration\n\nof justice.
