Stat. tit. 45, § 45-1.2","heading":"Violation of Board order - Notice - Hearing - Misdemeanor","body":"- Injunction - Action.\n\nA. Whenever the Board determines there are reasonable grounds\n\nto believe there has been a violation of any order of the Board\n\nadopted pursuant to Title 45 of the Oklahoma Statutes, it shall give\n\nwritten notice to the alleged violator specifying the cause of the\n\ncomplaint. Such notice shall require that the matters complained of\n\nbe corrected within a specified time or that the alleged violator\n\nappear before the Board at a time and place specified in the notice\n\nto answer the charges. The notice shall be delivered to the alleged\n\nviolator in accordance with the provisions of subsection C of this\n\nsection not less than twenty (20) days before the time set for the\n\nhearing.\n\nB. The Board shall afford the alleged violator an opportunity\n\nfor a hearing in conformity with the Administrative Procedures Act.\n\nOn the basis of the evidence produced at the hearing, the Board\n\nshall make findings of fact and conclusions of law and enter an\n\norder thereon. The Board shall give written notice of such order to\n\nthe alleged violator. The order of the Board shall become final and\n\nbinding on all parties unless appealed to the district court within\n\nthirty (30) days after notice of such order has been sent to the\n\nparties.\n\nC. Any notice, order or other instrument issued by the Board\n\npursuant to this section may be served either personally, by\n\npublication, or by mailing a copy by registered mail directed to the\n\nalleged violator at his last-known address as shown by the files or\n\nrecords of the Board. Proof of such service shall be filed in the\n\noffice of the Board.\n\nD. Unless otherwise specified by law, any person who violates\n\nany of the provisions of Title 45 of the Oklahoma Statutes or who\n\nviolates any order or determination of the Board promulgated\n\npursuant to this section shall be guilty of a misdemeanor and in\n\naddition thereto may be enjoined from continuing such violation.\n\nEach day upon which such violation occurs shall constitute a\n\nseparate violation.\n\nThe Attorney General, on the request of the Board, shall bring\n\nan action against any person violating any order or determination of\n\nthe Board adopted pursuant to Title 45 of the Oklahoma Statutes.","path":["OK Code","Title 45"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os45.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7a0ca519a8f4f9c18c045e8d1372ef33ec823d8ebc944f12a880f21a4e07e550","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-45-45-1","next":"us-ok/okla.-stat.-tit.-45-45-1.3"},"notice":"GroundRules: Original legal text.
