The Commission is authorized to spend monies from the State\n\nAbandoned Mine Reclamation Fund for the emergency restoration,\n\nreclamation, abatement, control or prevention of adverse effects of\n\ncoal mining practices on eligible land if it finds that:\n\n1. An emergency exists constituting a danger to the public\n\nhealth, safety or general welfare; and\n\n2. No other person or agency will act expeditiously to restore,\n\nreclaim, abate, control or prevent the adverse effects of coal\n\nmining practices.\n\nB. The Commission may enter on any land where an emergency\n\nexists and any other necessary access land to restore, reclaim,\n\nabate, control or prevent the adverse effects of coal mining\n\npractices and to do all things necessary or expedient to protect the\n\npublic health, safety or general welfare. This entry shall not be\n\nconstrued as an act of condemnation of property nor of trespass. The\n\nmonies expended for this work and the benefits accruing to the\n\npremises entered on shall be chargeable against the land and shall\n\nmitigate or offset any claim in or any action brought by any owner\n\nof any interest in the premises for any damages by virtue of the\n\nentry; provided, however, that this provision is not intended to\n\ncreate new rights of action or eliminate existing immunities.","path":["OK Code","Title 45"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os45.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a63b6213e7c7ba3709ba6b4ed6247911df8a885886c2a3186da68dd36ca214c0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-45-45-740.6","next":"us-ok/okla.-stat.-tit.-45-45-742.1"},"notice":"GroundRules: Original legal text.
