During the term of the permit the permittee may submit\n\nan application for a revision of the permit, together with a revised\n\nreclamation plan, to the Department. The Department shall\n\npromulgate by rule a definition of a major revision and a minor\n\nrevision. The fees for an application for a revision shall be:\n\nSaid fee shall be owing and due upon the Department's completion of\n\naction upon the application and said fee shall be paid in full prior\n\nto the issuance of any revised permit and the Department shall issue\n\nsaid revised permit no later than five (5) days after payment. The\n\nfees collected under this section shall be deposited in the\n\nDepartment of Mines Revolving Fund.\n\n2. An application for a revision of a permit shall not be\n\napproved unless the Department finds that reclamation as required by\n\nthis act can be accomplished under the revised reclamation plan. The\n\nrevision shall be approved or disapproved within a reasonable period\n\nof time. The Department shall establish guidelines for a\n\ndetermination of the scale or extent of a revision request for which\n\nall permit application information requirements and procedures,\n\nincluding notice and hearings, shall apply. Any revisions which\n\npropose significant alterations in the reclamation plan shall, at a\n\nminimum, be subject to notice and hearing requirements.\n\n3. Any extensions to the area covered by the permit except\n\nincidental boundary revisions shall be made by application for\n\nanother permit.\n\nB. The Department shall, within a time limit prescribed in\n\nregulations, review outstanding permits and may require reasonable\n\nrevision or modification of the permit provisions during the term of\n\nsuch permit.
