Stat. tit. 45, § 45-745.12","heading":"Advertisement of ownership, location and boundaries of","body":"affected land - Notice to political subdivisions, etc. - Comments on\n\nproposed operation.\n\nAt the time of submission of an application for a surface coal\n\nmining and reclamation permit, or revision of an existing permit,\n\nthe applicant shall submit to the Department a copy of his\n\nadvertisement of the ownership, precise location and boundaries of\n\nthe land to be affected. At the time of submission such\n\nadvertisement shall be placed by the applicant in a local newspaper\n\nof general circulation in the locality of the proposed surface mine\n\nat least once a week for four (4) consecutive weeks. The Department\n\nshall notify various local governmental bodies, planning agencies,\n\nsewage and water treatment authorities and water companies in the\n\nlocality in which the proposed surface mining will take place\n\nnotifying them of the operator's intention to surface mine a\n\nparticularly described tract of land and indicating the\n\napplication's permit number and where a copy of the proposed mining\n\nand reclamation plan may be inspected. These local bodies,\n\nagencies, authorities or companies may submit written comments\n\nwithin a reasonable period established by the Department on the\n\nmining applications with respect to the effect of the proposed\n\noperation on the environment which are within their areas of\n\nresponsibility.
