Stat. tit. 45, § 45-745.13","heading":"Objections to application for permit - Informal","body":"conference - Hearings.\n\nA. Any person having an interest which is or may be adversely\n\naffected, or the chief administrative officer of any federal, state\n\nor local governmental agency or authority, shall have the right to\n\nfile written objections to the application for a permit with the\n\nDepartment within thirty (30) days after the last publication of the\n\nnotice. Such objections shall immediately be transmitted to the\n\napplicant by the Department and shall be made available to the\n\npublic. If written objections are filed and an informal conference\n\nrequested, the Department shall then hold an informal conference in\n\nthe locality of the proposed mining. The date, time and location of\n\nsuch informal conference shall be advertised by the Department in a\n\nnewspaper of general circulation in the locality at least two (2)\n\nweeks prior to the scheduled conference date. The Department may\n\narrange with the applicant, upon request by any party to the\n\napplication process, access to the proposed mining area for the\n\npurpose of gathering information relevant to the proceeding. An\n\nelectronic or stenographic record shall be made of the conference\n\nproceeding, unless waived by all parties. Such record shall be\n\nmaintained and shall be accessible to the parties until final\n\nrelease of the applicant's performance bond. In the event all\n\nparties requesting the informal conference stipulate agreement prior\n\nto the requested informal conference and withdraw their requests,\n\nsuch informal conference need not be held.\n\nB. Where the lands included in an application for a permit are\n\nthe subject of a federal coal lease in connection with which\n\nhearings were held and determinations were made under the Mineral\n\nLands Leasing Act, as amended, 30 U.S.C. 201a, such hearings shall\n\nbe deemed as to the matters covered to satisfy the requirements of\n\nthis section and Section 17 of this act and such determinations\n\nshall be deemed to be a part of the record and conclusive for\n\npurposes of this section and Section 17 of this act.","path":["OK Code","Title 45"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os45.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3ebe366bdf588806206ef32db9b7fd970bcdcde5e545984e8dbebf7d93aa0d60","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-45-45-745.12","next":"us-ok/okla.-stat.-tit.-45-45-745.14"},"notice":"GroundRules: Original legal text.
