Stat. tit. 45, § 45-745.15","heading":"Temporary relief pending final determination of","body":"proceedings - Conduct of hearings - Appeals.\n\nWhen a hearing is requested pursuant to this act, the Department\n\nmay, under such conditions as it may prescribe, grant such temporary\n\nrelief as it deems appropriate pending final determination of the\n\nproceedings if:\n\n1. All parties to the proceedings have been notified and given\n\nan opportunity to be heard on a request for temporary relief;\n\n2. The person requesting such relief shows that there is a\n\nsubstantial likelihood that he will prevail on the merits of the\n\nfinal determination of the proceeding; and\n\n3. Such relief will not adversely affect the public health or\n\nsafety or cause significant imminent environmental harm to land, air\n\nor water resources.\n\nFor the purpose of this and every hearing authorized by this\n\nact, the Department may, pursuant to the Administrative Procedures\n\nAct, administer oaths, subpoena witnesses, or written or printed\n\nmaterials, compel attendance of the witnesses, or production of the\n\nmaterials, and take evidence including, but not limited to, site\n\ninspections of the land to be affected and other surface coal mining\n\noperations carried on by the applicant in the general vicinity of\n\nthe proposed operation. A verbatim record of each public hearing\n\nrequired by this act shall be made, and a transcript made available\n\non the motion of any party or by order of the Department.\n\nAny applicant or any person with an interest which is or may be\n\nadversely affected who has participated in the application process\n\nas an objector, and who is aggrieved by the decision of the\n\nDepartment, or if the Department fails to act within the time limits\n\nspecified in this act, shall have the right to appeal as provided by\n\nSection 53 of this act.","path":["OK Code","Title 45"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os45.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4593a0a3051dbe95e558bc509e3cadbb2887467c61de402f75f1df7e004d7b1b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-45-45-745.14","next":"us-ok/okla.-stat.-tit.-45-45-745.16.1"},"notice":"GroundRules: Original legal text.
