Stat. tit. 45, § 45-745.18","heading":"Impoundments of water on mining sites","body":"The operator may create, if authorized in the approved mining\n\nand reclamation plan and permit, permanent impoundments of water on\n\nmining sites as part of reclamation activities only when it is\n\nadequately demonstrated that:\n\n1. The size of the impoundment is adequate for its intended\n\npurposes;\n\n2. The impoundment dam construction will be so designed as to\n\nachieve necessary stability with an adequate margin of safety\n\ncompatible with that of structures constructed under Public Law 83-\n\n566 (16 U.S.C. 1006);\n\n3. The quality of impounded water will be suitable on a\n\npermanent basis for its intended use and that discharges from the\n\nimpoundment will not degrade the water quality below water quality\n\nstandards established pursuant to applicable federal and state law\n\nin the receiving stream;\n\n4. The level of water will be reasonably stable;\n\n5. Final grading will provide adequate safety and access for\n\nproposed water users; and\n\n6.
