Stat. tit. 45, § 45-745.4","heading":"Renewal of permit - Application - Burden of proof -","body":"Term.\n\nAny valid permit issued pursuant to this act shall carry with it\n\nthe right of successive renewal with respect to areas within the\n\nboundaries of the existing permit. The holders of the permit may\n\napply for renewal and such renewal shall be issued, provided that on\n\napplication for renewal the burden shall be on the opponents of\n\nrenewal, subsequent to fulfillment of the public notice requirements\n\nof Sections 15 and 17 of this act unless it is established that and\n\nwritten findings by the Department are made declaring:\n\n1. The terms and conditions of the existing permit are not\n\nbeing satisfactorily met;\n\n2. The present surface coal mining and reclamation operation is\n\nnot in compliance with the environmental protection standards of\n\nthis act and the state program;\n\n3. The renewal requested substantially jeopardizes the\n\noperator's continuing responsibility on existing permit areas;\n\n4. The operator has not provided evidence that the performance\n\nbond in effect for said operation will continue in full force and\n\neffect for any renewal requested in such application as well as any\n\nadditional bond the Department might require; or\n\n5. Any additional revised or updated information required by\n\nthe Department has not been provided. Prior to the approval of any\n\nrenewal of permit the Department shall provide notice to the\n\nappropriate public authorities.\n\nIf an application for renewal of a valid permit includes a\n\nproposal to extend the mining operation beyond the boundaries\n\nauthorized in the existing permit, the portion of the application\n\nfor renewal of a valid permit which addresses any new land areas\n\nshall be subject to the full standards applicable to new\n\napplications under this act.\n\nAny permit renewal shall be for a term not to exceed the period\n\nof the original permit established by this act.
