Each applicant for a permit shall be required to submit to\n\nthe Department as part of the permit application a reclamation plan\n\nwhich shall meet the requirements of this act. Each reclamation\n\nplan submitted as part of a permit application shall include, in the\n\ndegree of detail necessary to demonstrate that reclamation required\n\ncan be accomplished, a statement of:\n\n1. The identification of the lands subject to surface coal\n\nmining operations over the estimated life of those operations and\n\nthe size, sequence and timing of the subareas for which it is\n\nanticipated that individual permits for mining will be sought;\n\n2. The condition of the land to be covered by the permit prior\n\nto any mining including:\n\na. the uses existing at the time of the application, and\n\nif the land has a history of previous mining, the uses which\n\npreceded any mining,\n\nb. the capability of the land prior to any mining to\n\nsupport a variety of uses giving consideration to soil and\n\nfoundation characteristics, topography, vegetative cover and, if\n\napplicable, a soil survey, and\n\nc. the productivity of the land prior to mining, including\n\nappropriate classification as prime farmlands, as well as the\n\naverage yield of food, fiber, forage or wood products from such\n\nlands obtained under high levels of management;\n\n3. The use which is proposed to be made of the land following\n\nreclamation, including a discussion of the utility and capacity of\n\nthe reclaimed land to support a variety of alternative uses and the\n\nrelationship of such use to existing land use policies and plans,\n\nand the comments of any owner of the surface, state and local\n\ngovernments or agencies thereof which would have to initiate,\n\nimplement, approve or authorize the proposed use of the land\n\nfollowing reclamation;\n\n4. A detailed description of how the proposed postmining land\n\nuse is to be achieved and the necessary support activities which may\n\nbe needed to achieve the proposed land use;\n\n5. The engineering techniques proposed to be used in mining\n\nand reclamation and a description of the major equipment; a plan for\n\nthe control of surface water drainage and of water accumulation; a\n\nplan, where appropriate, for backfilling, soil stabilization, and\n\ncompacting, grading and appropriate revegetation; a plan for soil\n\nreconstruction, replacement and stabilization; an estimate of the\n\ncost per acre of the reclamation, including a statement as to how\n\nthe permittee plans to comply with each of the requirements of\n\nOklahoma mining reclamation law;\n\n6. The consideration which has been given to maximize the\n\nutilization and conservation of the solid fuel resource being\n\nrecovered so that reaffecting the land in the future can be\n\nminimized;\n\n7. A detailed estimated timetable for the accomplishment of\n\neach major step in the reclamation plan;\n\n8. The consideration which has been given to making the\n\nsurface mining and reclamation operations consistent with surface\n\nowner plans, and applicable state and local land use plans and\n\nprograms; 9. The steps to be taken to comply with applicable air\n\nand water quality laws and regulations and any applicable health and\n\nsafety standards;\n\n10. The consideration which has been given to developing the\n\nreclamation plan in a manner consistent with local physical\n\nenvironmental, and climatological conditions;\n\n11. All lands, interests in lands, or options on such\n\ninterests held by the applicant or pending bids on interests in\n\nlands by the applicant, which lands are contiguous to the area to be\n\ncovered by the permit;\n\n12. The results of test boring which the applicant has made at\n\nthe area to be covered by the permit, or other equivalent\n\ninformation and data, including the location of subsurface water,\n\nand an analysis of the chemical properties including acid-forming\n\nproperties of the coal and other minerals and overburden.\nthe applicant, which lands are contiguous to the area to be\n\ncovered by the permit;\n\n12. The results of test boring which the applicant has made at\n\nthe area to be covered by the permit, or other equivalent\n\ninformation and data, including the location of subsurface water,\n\nand an analysis of the chemical properties including acid-forming\n\nproperties of the coal and other minerals and overburden.\n\nInformation which pertains only to the analysis of the chemical and\n\nphysical properties of the coal shall be kept confidential and not\n\nmade a matter of public record. Information regarding mineral or\n\nelemental contents which are potentially toxic in the environment\n\nshall be a part of the public record;\n\n13. A detailed description of the measures to be taken during\n\nthe mining and reclamation process to assure the protection of:\n\na. the quality of surface and ground water systems, both\n\non- and off-site, from adverse effects of the mining and reclamation\n\nprocess,\n\nb. the rights of present users to such water, and\n\nc. the quantity of surface and ground water systems, both\n\non- and off-site, from adverse effects of the mining and reclamation\n\nprocess or to provide alternative sources of water where such\n\nprotection of quantity cannot be assured; and\n\n14. Such other requirements as the Department shall prescribe\n\nby regulations.\n\nB. Any information required by this section which is not on\n\npublic file pursuant to state law shall be held in confidence by the\n\nDepartment.
