Stat. tit. 45, § 45-745.9","heading":"Schedule of notices of violations of air or water","body":"environmental protection laws to be submitted - Effect of prior\n\nviolations on application.\n\nThe applicant shall file with his permit application a schedule\n\nlisting all notices of violations of this act and any law, rule or\n\nregulation of the United States, or of any department or agency in\n\nthe United States, pertaining to air or water environmental\n\nprotection incurred by the applicant in connection with any surface\n\ncoal mining operation during the three-year period prior to the date\n\nof application. The schedule shall also indicate the final\n\nresolution of any such notice of violation. When the schedule or\n\nother information available to the Department indicates that any\n\nsurface coal mining operation owned or controlled by the applicant\n\nis currently in violation of this act or such other laws referred to\n\nin this section, the permit shall not be issued until the applicant\n\nsubmits proof that such violation has been corrected or is in the\n\nprocess of being corrected to the satisfaction of the regulatory\n\nauthority which has jurisdiction over such violation. No permit\n\nshall be issued to an applicant after a finding by the Department,\n\nafter opportunity for hearing, that the applicant or the operator\n\nspecified in the application, controls or has controlled mining\n\noperations with a demonstrated pattern of willful violations of this\n\nact or the laws of another state or the United States regulating\n\nsurface coal mining operations of such nature and duration with such\n\nresulting irreparable damage to the environment as to indicate an\n\nintent not to comply with the provisions of this act.","path":["OK Code","Title 45"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os45.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"49ca973f0d7a78d668faaa1f7bc9e7d5b1ddb76fc0418bb5872faaab42cb3020","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-45-45-745.8","next":"us-ok/okla.-stat.-tit.-45-45-746"},"notice":"GroundRules: Original legal text.
