Stat. tit. 45, § 45-748","heading":"Conditions where backfilling, compacting, and grading are","body":"necessary.\n\nIn surface coal mining:\n\n1. Which is carried out at the same location over a substantial\n\nperiod of time when the operation transects the coal deposit;\n\n2. The thickness of the coal deposits relative to the volume of\n\nthe overburden is large; and\n\n3. Where the operator demonstrates that the overburden and\n\nother spoil and waste materials at a particular point in the permit\n\narea or otherwise available from the entire permit area is\n\ninsufficient, giving due consideration to volumetric expansion, to\n\nrestore the approximate original contour;\n\nthe operator, at a minimum, shall backfill, grade and compact, where\n\nadvisable, using all available overburden and other spoil and waste\n\nmaterials to attain the lowest practicable grade but not more than\n\nthe angle of repose.
