Stat. tit. 45, § 45-749","heading":"Restoring excess overburden, spoils and waste materials","body":"In surface coal mining where the volume of overburden is large\n\nrelative to the thickness of the coal deposit and where the operator\n\ndemonstrates that due to volumetric expansion the amount of\n\noverburden and other spoil and waste materials removed in the course\n\nof the mining operation is more than sufficient to restore the\n\napproximate original contour, the operator shall after restoring the\n\napproximate contour, backfill, grade and compact, where advisable,\n\nthe excess overburden and other spoil and waste materials to attain\n\nthe lowest grade but not more than the angle of repose, and cover\n\nall acid-forming and other toxic materials, in order to achieve an\n\necologically sound land use compatible with the surrounding region.\n\nSuch overburden or spoil shall be shaped and graded in such a way as\n\nto prevent slides, erosion and water pollution and shall be\n\nrevegetated in accordance with the requirements of this act.","path":["OK Code","Title 45"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os45.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"18321e6a972b9429d68ecfe18ef9afd65456dcb5d7a889dd84bf6299cc356134","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-45-45-748","next":"us-ok/okla.-stat.-tit.-45-45-750"},"notice":"GroundRules: Original legal text.
