Stat. tit. 45, § 45-751","heading":"Disturbances to hydrologic balance","body":"The operator shall minimize the disturbances to the prevailing\n\nhydrologic balance, at the mine site and in associated offsite\n\nareas, and to the quality and quantity of water in surface and\n\nground water systems both during and after surface coal mining\n\noperations and during reclamation by:\n\n1. Avoiding acid or other toxic mine drainage by such measures\n\nas, but not limited to:\n\na. preventing or removing water from contact with toxic\n\nproducing deposits,\n\nb. treating drainage to reduce toxic content which\n\nadversely affects downstream water upon being released to water\n\ncourses, and\n\nc. casing, sealing, or otherwise managing boreholes,\n\nshafts, and wells and keeping acid or other toxic drainage from\n\nentering ground and surface waters;\n\n2. a. Conducting surface coal mining operations so as to\n\nprevent, to the extent possible using the best technology\n\ncurrently available, additional contributions of suspended solids to\n\nstreamflow, or runoff outside the permit area, but in no event shall\n\ncontributions be in excess of requirements set by applicable state\n\nor federal law, and\n\nb. constructing any siltation structures pursuant to this\n\nparagraph prior to commencement of surface coal mining operations.\n\nSuch structures shall be certified by a qualified registered\n\nengineer to be constructed as designed and as approved in the\n\nreclamation plan;\n\n3. Cleaning out and removing temporary or large settling ponds\n\nor other siltation structures from drainways after disturbed areas\n\nare revegetated and stabilized, and depositing the silt and debris\n\nat a site and in a manner approved by the Department;\n\n4. Restoring recharge capacity of the mined area to\n\napproximate premining conditions;\n\n5. Avoiding channel deepening or enlargement in operations\n\nrequiring the discharge of water from mines;\n\n6. Preserving throughout the mining and reclamation process\n\nthe essential hydrologic functions of alluvial valley floors in the\n\narid and semiarid areas of the country; and\n\n7.
