The operator shall establish on the regraded areas and all\n\nother lands affected, a diverse, effective and permanent vegetative\n\ncover of the same seasonal variety native to the area of land to be\n\naffected and capable of self-regeneration and plant succession at\n\nleast equal in extent of cover to the natural vegetation of the\n\narea; except, that introduced species may be used in the\n\nrevegetation process where desirable and necessary to achieve the\n\napproved postmining land use plan.\n\nB. The operator shall assume the responsibility for successful\n\nrevegetation for a period of five (5) full years after the last year\n\nof augmented seeding, fertilizing, irrigation or other work in order\n\nto assure compliance with this section. In those areas or regions\n\nof Oklahoma, where the annual average precipitation is twenty-six\n\n(26) inches or less as determined by the most recent National\n\nOceanic and Atmospheric Administration Annual Summary of\n\nClimatological Data for Oklahoma, then the operator's assumption of\n\nresponsibility and liability will extend for a period of ten (10)\n\nfull years after the last year of augmented seeding, fertilizing,\n\nirrigation or other work. When the Department approves a long-term\n\nintensive agricultural postmining land use, the applicable five- or\n\nten-year period of responsibility for revegetation shall commence at\n\nthe date of initial planting for such long-term intensive\n\nagricultural postmining land use.
