Stat. tit. 45, § 45-754.1","heading":"Spoil material - Placement","body":"The operator shall place all excess spoil material resulting\n\nfrom coal surface mining and reclamation activities in such a manner\n\nthat:\n\n1. Spoil is transported and placed in a controlled manner in\n\nposition for concurrent compaction and in such a way to assure mass\n\nstability and to prevent mass movement;\n\n2. The areas of disposal are within the bonded permit areas and\n\nall organic matter shall be removed immediately prior to spoil\n\nplacement;\n\n3. Appropriate surface and internal drainage systems and\n\ndiversion ditches are used so as to prevent spoil erosion and\n\nmovement;\n\n4. The disposal area does not contain springs, natural water\n\ncourses or wet weather seeps unless lateral drains are constructed\n\nfrom the wet areas to the main underdrains in such a manner that\n\nfiltration of the water into the spoil pile will be prevented;\n\n5. If placed on a slope, the spoil is placed upon the most\n\nmoderate slope among those upon which, in the judgment of the\n\nDepartment, the spoil could be placed in compliance with all the\n\nrequirements of this act, and shall be placed, where possible, upon,\n\nor above, a natural terrace, bench, or berm, if such placement\n\nprovides additional stability and prevents mass movement;\n\n6. Where the toe of the spoil rests on a downslope, a rock toe\n\nbuttress, of sufficient size to prevent mass movement, is\n\nconstructed;\n\n7. The final configuration is compatible with the natural\n\ndrainage pattern and surroundings and suitable for intended uses;\n\n8. Design of the spoil disposal area is certified by a\n\nqualified registered professional engineer in conformance with\n\nprofessional standards; and\n\n9.
