Stat. tit. 45, § 45-754.2","heading":"Performance standards","body":"The operator shall also fulfill the following performance\n\nstandards:\n\n1. Conduct surface coal mining operations so as to maximize the\n\nutilization and conservation of the solid fuel resource being\n\nrecovered so that reaffecting the land in the future through surface\n\ncoal mining can be minimized;\n\n2. Stabilize and protect all surface areas including spoil\n\npiles affected by the surface coal mining and reclamation operation\n\nto effectively control erosion and attendant air and water\n\npollution;\n\n3. Restore the topsoil or the best available subsoil which is\n\nbest able to support vegetation;\n\n4. Insure that all debris, acid-forming materials, toxic\n\nmaterials, or materials constituting a fire hazard are treated or\n\nburied and compacted or otherwise disposed of in a manner designed\n\nto prevent contamination of ground or surface waters and that\n\ncontingency plans are developed to prevent sustained combustion;\n\n5. Insure that the construction, maintenance and postmining\n\nconditions of access roads into and across the site of operations\n\nwill control or prevent erosion and siltation, pollution of water,\n\ndamage to fish or wildlife or their habitat, or public or private\n\nproperty;\n\n6. Refrain from the construction of roads or other access ways\n\nup a stream bed or drainage channel or in such proximity to such\n\nchannel so as to seriously alter the normal flow of water;\n\n7. Protect off-site areas from slides or damage occurring\n\nduring the surface coal mining and reclamation operations, and not\n\ndeposit spoil material or locate any part of the operations or waste\n\naccumulations outside the permit area;\n\n8. To the extent possible using the best technology currently\n\navailable, minimize disturbances and adverse impacts of the\n\noperation on fish, wildlife, and related environmental values, and\n\nachieve enhancement of such resources where practicable;\n\n9. Provide for an undisturbed natural barrier beginning at the\n\nelevation of the lowest coal seam to be mined and extending from the\n\noutslope for such distance as the Department shall determine shall\n\nbe retained in place as a barrier to slides and erosion; and\n\n10.
