Stat. tit. 45, § 45-755","heading":"Steep slope surface mining - Performance standards -","body":"Exemptions.\n\nThe following performance standards shall be applicable to steep\n\nslope surface coal mining and shall be in addition to those general\n\nperformance standards required by this act. These provisions shall\n\nnot apply to those situations in which an operator is mining on flat\n\nor gently rolling terrain, on which an occasional steep slope is\n\nencountered through which the mining operation is to proceed,\n\nleaving a plain or predominantly flat area.\n\n1. The operator shall insure that when performing surface coal\n\nmining on steep slopes, no debris, abandoned or disabled equipment,\n\nspoil material, or waste mineral matter be placed on the downslope\n\nbelow the bench or mining cut;\n\n2. Complete backfilling with spoil material shall be required\n\nto cover completely the highwall and return the site to the\n\nappropriate original contour, which material will maintain stability\n\nfollowing mining and reclamation;\n\n3. The operator may not disturb land above the top of the\n\nhighwall unless the Department finds that such disturbance will\n\nfacilitate compliance with the environmental protection standards of\n\nthis act. The land disturbed above the highwall shall be limited to\n\nthat amount necessary to facilitate said compliance; and\n\n4.
