The representatives of the Department may enter upon the\n\nlands of the operator at all times deemed reasonable and necessary\n\nby the Department without advance notice and upon presentation of\n\nappropriate credentials for the purpose of inspection, to determine\n\nwhether the provisions of this act have been complied with, and may\n\nat reasonable times, and without delay, have access to and copy any\n\nrecords, inspect any monitoring equipment or method of operation\n\nrequired under this act.\n\nB. The inspections by the Department shall:\n\n1. Occur on an irregular basis averaging at least one partial\n\ninspection per month for each active surface coal mining and\n\nreclamation operation covered by permit. Partial inspections on\n\neach inactive surface coal mining and reclamation operation covered\n\nby permit shall be conducted as necessary to ensure the effective\n\nenforcement of this act. At least one complete inspection shall be\n\nconducted per calendar quarter on each active and inactive surface\n\ncoal mining and reclamation operation covered by permit.\n\nFor the purpose of this section, an inactive surface coal mining\n\nand reclamation operation is defined as those operations which have\n\nobtained at least a sixty percent (60%) bond release pursuant to\n\nparagraph 1 of subsection A of Section 772 of this title. All other\n\nsurface coal mining operations shall be considered as active;\n\n2. Occur without prior notice to the permittee or his agents or\n\nemployees except for necessary on-site meetings with the permittee;\n\nand\n\n3. Include the filing of inspection reports adequate to enforce\n\nthe requirements of and to carry out the terms and purposes of this\n\nact.\n\nC. Each permittee shall maintain in a conspicuous place at the\n\nentrances to the surface coal mining and reclamation operations\n\nclearly visible signs which set forth the name, business address and\n\nphone number of the permittee and the permit number of the surface\n\ncoal mining and reclamation operations.\n\nD. Each inspector, upon detection of each violation of any\n\nrequirement of this act, shall immediately inform the operator in\n\nwriting of the violation, and shall report in writing any such\n\nviolation to the Department.\n\nE. Copies of any records, reports, inspection materials or\n\ninformation obtained under this act by the Department shall be made\n\nimmediately available for inspection by the public at central and\n\nsufficient locations designated by the Department in the county,\n\nmulticounty and state area of mining so that they are conveniently\n\navailable to residents in the areas of mining, excepting such\n\ninformation required to be kept confidential by this act.","path":["OK Code","Title 45"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os45.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ce2c0b7c5517ccc48fcc795338b7836dcd6a2fba84a17582cbdc71b1402c2a4e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-45-45-765","next":"us-ok/okla.-stat.-tit.-45-45-767"},"notice":"GroundRules: Original legal text.
