Stat. tit. 45, § 45-776","heading":"Conditions or practices in violation of act - Cessation","body":"order - Additional obligations on operator.\n\nIf, on the basis of any inspection, the Department determines\n\nthat any unacceptable condition or practice exists, or that any\n\npermittee is in violation of any requirement of this act or any\n\npermit condition required by this act, which condition, practice or\n\nviolation also creates an imminent danger to the health or safety of\n\nthe public, or is causing, or can reasonably be expected to cause\n\nsignificant, imminent environmental harm to land, air or water\n\nresources, the Department shall immediately order a cessation of\n\nsurface coal mining and reclamation operations or the portion\n\nthereof relevant to the condition, practice or violation. Such\n\ncessation order shall remain in effect until the Department\n\ndetermines that the condition, practice or violation has been\n\nabated, or until modified, vacated or terminated by the Department.\n\nIf the Department finds that the ordered cessation of surface coal\n\nmining and reclamation operations, or any portion thereof, will not\n\ncompletely abate the imminent danger to the health or safety of the\n\npublic or the significant imminent environmental harm to land, air\n\nor water resources, the Department shall, in addition to the\n\ncessation order, impose affirmative obligations on the operator\n\nrequiring him to take whatever steps the Department deems necessary\n\nto abate the imminent danger or the significant environmental harm.","path":["OK Code","Title 45"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os45.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0c38511ba3aebbb4b0feab8814bd6cfe0892b6b5afd72fd89c3f6d86569fbc37","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-45-45-775","next":"us-ok/okla.-stat.-tit.-45-45-777"},"notice":"GroundRules: Original legal text.
